FinForta General Terms and Conditions
These General Terms and Conditions ("the Terms") apply to the FinForta platform, its affiliates, or partners, collectively referred to as "the Platform," "FinForta," "we," "us," and/or "our(s)." These Terms also govern FinForta products and services ("the Services").
In these Terms, any user of the Platform, including employees, agents, affiliates, owners, partners, or any other entity related to such user, whether registered or considering registration, is addressed as "You" or "Your" concerning personal rights and liabilities, and as "user(s)" in a general context.
Acceptance of Terms
By utilizing the Platform, you explicitly agree to abide by these Terms. If you disagree, kindly refrain from using the Platform.
FinForta reserves the right, at its sole discretion, to modify, add, or remove portions of these Terms at any time. It is Your responsibility to review these Terms for changes periodically. Continued use of the Platform after changes are posted indicates Your acceptance of and Agreement to the modified Terms.
As long as You adhere to these Terms, FinForta grants You a personal, non-exclusive, non-transferable, and limited privilege to access and use the Platform.
General Definitions
Virtual Currencies: Digital representations of value functioning as a medium of exchange, a unit of account, and/or a store of value. These employ cryptographic techniques to regulate digital unit generation and verify asset transfers via blockchain. Virtual Currencies have no Legal Tender and operate independently from central banks in any jurisdiction.
Stablecoins: A category of virtual currency that can be pegged to virtual currency, fiat money, or exchange-traded commodities of legal tender.
Cryptoassets: When referred to jointly, the collective term encompassing Virtual Currencies and Stablecoins.
Fiat Currencies: Money or currency recognized by a government as a Legal Tender, deriving value from the government's backing. It does not include any virtual currency.
Funds: A term encompassing Crypto assets and/or Fiat Currencies of Legal Tender when referred to jointly.
Legal Tender: Any national currency (e.g., U.S. dollars or EURO) that can be used in connection with cryptoassets via the Services. It excludes virtual currencies.
Blockchain: A system where transaction records made in Virtual Currency are maintained across interconnected computers in a peer-to-peer network.
KYC: Abbreviation for Know Your Customer (or Client), the process of verifying the identity of customers or clients and assessing potential risks of illegal intentions for the business relationship.
AML: Abbreviation for Anti-Money Laundering, a set of procedures, laws, and regulations designed to prevent generating income through illegal actions.
Your Account: A user's account accessible at FinForta via the Services offered on the Platform, where Funds may be stored.
Individual Account: Owned by a single person or entity with the ability to transfer or withdraw virtual currency. A maximum of 1 (one) Individual Account is allowed per individual.
Corporate Account: Owned by any legal entity holding an Account in any capacity other than an individual one.
Affiliate: Any legal entity related to FinForta through share ownership, joint ownership, or other means of control, including parent companies and subsidiaries.
Partner: Any entity or individual that has entered into a partnership agreement with FinForta and/or integrated any FinForta products into its website.
GENERAL TERMS AND CONDITIONS
1. PLATFORM MANAGEMENT BY THE FinForta GROUP OF COMPANIES
1.1 FinForta, a global group of companies, operates the finforta.com digital platform and associated services. The Platform serves as an information and technological solution, providing various digital services globally.

2. REGISTRATION ON THE PLATFORM AND ACCOUNT CREATION
2.1 By registering on the Platform and accepting these Terms, you enter into a comprehensive agreement with FinForta. Only registered users are entitled to utilize FinForta's products and services.
2.2 When using the Platform, confirm that you:
2.2.1 Are you an eligible individual or a legal entity with total legal capacity in your domicile? 2.2.2 Are at least 18 years old. 2.2.3 Are not subject to any insolvency proceedings. 2.2.4 Have the legal capacity to enter into a binding contract. 2.2.5 Are not under the influence of substances impairing judgment.
2.3 Do not register if you are a resident of a jurisdiction where FinForta is unauthorized to provide services or if your use of services is deemed illegal.
3. KYC PROCEDURE AND ACCOUNT ACTIVATION
3.1 To activate your account, undergo the Know Your Customer (KYC) procedure as per FinForta's Anti-Money Laundering (AML) policy.
3.2 Partnership with a regulated entity may exempt you from additional KYC if compliant with European Union AML/KYC requirements.
3.3 Your unique ID number, assigned upon registration, is the primary identification for Platform services.
4. YOUR DATA
4.1 FinForta processes your data as defined in the Privacy Policy. By accepting the Agreement, you consent to this data processing.
4.2 Personal data processing purposes include record-keeping, service provision, financial and statistical analysis, and rights protection.
4.3 KYC data may be shared with third parties in compliance with applicable regulations.
5. YOUR IDENTIFICATION
5.1 Identification follows FinForta's internal control system and AML policy.
5.2 You authorize us to verify your identity and use credit reports or third-party information.
5.3 Provide true, accurate, and up-to-date information. Notify us promptly of any changes.
6. CURRENCIES AND FUNDS TRANSFER
6.1 Only listed Virtual Currencies and Fiat Currencies are accepted. Changes may occur without prior notice.
6.2 Represent and warrant ownership or valid authorization for funds in your account.
6.3 Funds transferable to FinForta are for specific product purposes.
6.4 Transaction requests are pending until we accept them. We may refuse or delay for various reasons.
7. PAYMENT FOR PLATFORM SERVICES
7.1 Pay service fees as per the Fees listed on the Platform.
7.2 We may withdraw service fees from your FinForta account without prior notification.
8. YOUR RIGHTS AND OBLIGATIONS
8.1 You undertake not to engage in illicit conduct, provide accurate information, use secure means for electronic communications, and promptly update changes.
8.2 False information may result in service termination.
9. FinForta's RIGHTS AND OBLIGATIONS
9.1 FinForta aims to keep the Platform operational, accessible, and secure.
9.2 FinForta is not liable for taxes resulting from your transactions. Additional services are subject to these Terms.
10. ACCOUNT STATEMENTS
10.1 Account statements are available online or via email upon request.
10.2 Notify us of any discrepancies within 30 days of statement availability.
11. TAXES
11.1 Determine and comply with applicable taxes related to your transactions.
11.2 FinForta does not withhold taxes unless legally required.
12. TRANSFER OF YOUR ACCOUNT
12.1 Your account is non-transferable. Transfers require verification of the new user.
12.2 Unauthorized platform use is prohibited.
13. AMENDMENT AND TERMINATION OF AGREEMENT
13.1 FinForta may change Terms without notice. Continued use implies Agreement.
13.2 FinForta may restrict, terminate, or delete your account for various reasons.
13.3 To terminate, notify FinForta three business days in advance.
14. RISK DISCLOSURE
14.1 No fiduciary relationship is established.
14.2 Your account is not insured, and Crypto assets are not Legal Tender.
14.3 Legislative changes may affect Cryptoasset use and value.
14.4 Consider risks carefully.
15. DISCLAIMER, INDEMNIFICATION, AND LIABILITY LIMITATION
15.1 The Platform is provided "as is" without warranties.
15.2 FinForta is not liable for indirect damages, and your liability indemnifies FinForta.
15.3 FinForta's maximum liability is your funds in the account at the time of loss.
16. LEGAL PROCESS AFFECTING ACCOUNTS
16.1 Legal procedures may affect account withdrawals or transfers.
16.2 We reserve the right to claim funds in case of legal procedures.
16.3 We may charge expenses related to legal procedures.
17. OTHER TERMS AND CONDITIONS
17.1 The Agreement is effective upon your Agreement and account creation.
17.2 Terms are binding until account deletion and product commitments fulfillment.
17.3 English versions of the Terms prevail in case of translation discrepancies.
17.4 Legal notices may be published on the Platform without additional notification.
